3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account

You must be at least 16 years old to create an account and use the Service.

4. Subscription Plans and Payment

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

4.4 Refunds

5. Acceptable Use

You agree not to use the Service to:

• Infringe upon the rights of others
• Index content you do not own or have permission to index
• Distribute malware, spam, or harmful content

• Attempt to gain unauthorized access to any part of the Service

• Scrape or collect data from the Service without permission
• Resell or redistribute the Service without authorization

6. Your Content

6.1 Ownership

You retain ownership of all content you submit to the Service, including website content that is crawled and indexed. We do not claim ownership of your content.

By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, process, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for the content you submit and represent that you have all necessary rights to grant us the license above. You agree not to submit content that is illegal, infringing, or harmful.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of FlowSearch. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

The Service may integrate with or rely on third-party services including but not limited to:

• Payment processors (Stripe)
• Authentication providers (Google, GitHub)
• Analytics services (Google Analytics)
• AI services (OpenAI)
• Search infrastructure (Typesense)
• Database and hosting (Supabase, Vercel)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance, resulting in interruptions, delays, or errors.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will function uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLOWSEARCH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless FlowSearch and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FlowSearch operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlowSearch regarding your use of the Service and supersede all prior agreements and understandings.
